Right of withdrawal
In accordance with article. 5 DL 185/1999, if the customer is a consumer (ie a person who buys goods for purposes not related to his profession), has the right to terminate the purchase contract for any reason, without explanation and without penalty, except as described in the following paragraphs. To exercise this right, the Customer will have to do the following actions:
- Send a PEC e-mail to arya_by_sabrina@pec.it or a registered letter to GA – ARYA di S. Cecchini – Piazza Riconoscenza 7a-21047 Saronno (Va) with the subject “Right to Withdraw ‘within 14 calendar days of receipt of goods. In no case will it be possible to accept a return in the absence of a communication by registered letter (postal or certified e-mail);
- Specifying the items to be returned providing the Product Code, which you can find in the copy of the order received by e-mail;
- Return the products for which it intends to exercise the right of withdrawal within 14 days from the date of the communication. The goods must be returned to: GA – ARYA di S.Cecchini – Piazza Riconoscenza 7a – 21047 Saronno (Va) taking care to prepare the package by inserting it in a suitable box or a padded envelope and using a registered shipping;
- In no event can expect accept returns of worn, dirty and/or damaged merchandise, albeit partially, and customized goods, unless it is possible to restore the item to its original condition. The cost for the restoration will be deducted from the amount to be reimbursed.
Terms and Conditions
- The law applies to product purchased in its entirety: it is not possible to exercise the right of return only on a part of the product or to products created or modified specifically for the customer;
- The products must be returned intact and in original packaging, complete in all its parts;
- To limit damage to the original package, we recommend, when possible, to put it in another box or padded envelope;
- Should be avoided in all cases the attachment of labels or tape directly on the packaging of the product:
- The shipping costs for returning the goods are always borne by the customer, except for mistake in sending the goods or a defect in the article sent;
- The expedition, until the arrive in our warehouse, is under the complete responsibility of the customer. We recommend using a assured shipping;
- The right of withdrawal is excluded for customers with VAT;
- The return of the goods is allowed within the European Community only.
If the goods are damaged during transport GA will inform the customer within 5 working days of receipt of goods to enable him to file a timely complaint against the courier and obtain refund of the value of the property (if insured). In this case, the product will be made available to the customer for the return and will be canceled the request for Return Policy. GA does not respond in any way for damage or theft/loss of goods returned by uninsured shipments. Upon arrival at the venue, the product will be examined to assess any damages not caused by transport. If the package and / or the original packaging are damaged, GA will deduct from the refund due to a percentage not exceeding 10% of the same, for the replacing the package.
Refund
Without prejudice to any repair costs for damage to the original package, GA will refund the customer the consumer the amount paid within 14 days from the receipt of the returned items.
Shipment charges are excluded from any refund. In case of Free Shipment, GA will deduct the amount of 7€ from the reimbursement.
From the reimbursement, a fee of € 5.00 will also be withheld for the management of the withdrawal procedure.
In any case, the payment commissions charged on the original transaction will be withheld (Paypal, Stripe, Credit Card).
In case of withdrawal after a successful change of goods, the amount of the reimbursement will be net of the expenses incurred for sending the replacement item, if not previously debited.
GA reserves the right to withhold the reimbursement until he has received the goods, verified its integrity in order to accept the right of withdrawal, and until receipt of the tax code of the Customer, necessary for tax obligations.
The refund will be made:
– with reversal of the amount charged, for payments made with Paypal or Banca Sella;
– by bank transfer, in other cases.
The buyer must promptly provide the bank details on which to make the repayment (Iban and account header).
Loss of the right of withdrawal
The right of withdrawal is lost for lack of essential integrity of the property (the packaging and / or content), when it occurs:
- The absence of external and / or internal packaging;
- The absence of product components;
- Damage to the product for reasons other than transportation.
If are not complied with the conditions and terms of the right of withdrawal, the customer is not entitled to reimbursement of the amounts already paid. In this case the customer can reclaim the items in the state in which they were returned to GA, upon payment of referral fees. Otherwise, GA is entitled to keep the articles and sums paid by the customer.
